Promotions & Subscriptions

1.  Backgrounds
1. This clause applies to all promotional offers, competitions or Subscriptions that are made available by DigiDevs and instructions on how to claim and the rewards form part of these Terms and Conditions. 
2. Participation in any DigiDevs promotional offer, competition or Subscription is deemed acceptance by you of these Terms and Conditions. 
2. Definitions
1. In this clause:
1. Immediate Family:  means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
2. Subscriber, Customer or You: means a person who is a subscriber to DigiDevs email communication, or user of DigiDevs.com.au.
3. Subscription: means an email subscription taken up directly with DigiDevs, and for which these terms and conditions apply.
3. Terms and Conditions
1. Promotional offers and competitions are only open to Australian residents and/or registered Australian businesses with a valid ABN who are subscribers to DigiDevs email communication.
2. Unless otherwise stated,:
1. only one offer redemption per Subscription is permitted; and 
2. promotional offers not valid in conjunction with any other offer.
3. Employees (and their Immediate Families) of DigiDevs and agencies associated with this promotion are ineligible to claim promotional offers or to participate in competitions.
4. DigiDevs reserves the right, at any time, to:
1. verify the validity of claims and claimants (including a claimant’s identity, age and place of residence); and 
2. disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process,

and any failure by DigiDevs to enforce any of its rights at any stage does not constitute a waiver of those rights.

5. If there is a dispute as to the identity of a claimant, DigiDevs reserves the right, in its discretion, to determine the identity of the claimant.
6. Incomplete, indecipherable or illegible claims will be invalid.
7. The validity and duration of any promotional offer or competition is subject to the terms of each participating offer, or otherwise when stock runs out (whichever is first). Refer to each participating offer for specific terms.
8. DigiDevs’s decision with respect to any competition, promotion or Subscription is final and no correspondence will be entered into.
9. Promotional offers maybe subject to the standard terms and conditions of individual reward and service providers.
10. If for any reason a claimant does not redeem the reward or an element of the reward by the time stipulated by DigiDevs, then the reward or that element of the reward will be forfeited.
11. If any reward (or part of any reward) is unavailable, DigiDevs at its discretion, reserves the right to substitute the reward (or that part of the reward) with a reward to the equal value and/or specification.
12. Rewards, or any unused portion of a reward, are not transferable or exchangeable and cannot be taken as cash.
13. Notwithstanding DigiDevs Privacy Policy, claimants consent to DigiDevs using their:
1. name;
2. likeness;
3. image; or 
4. voice (including photograph, film and/or recording of the same),

in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by DigiDevs.

14. If this promotion is interfered with in any way or is not capable of being conducted as anticipated, DigiDevs reserves the right to:
1. disqualify any claimant; or 
2. modify, suspend, terminate or cancel the promotional offer or competition as appropriate.
15. Any cost associated with accessing the promotional offer or competition is the claimant’s responsibility and is dependent on the Internet service provider used.
16. The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that entrant invalid.
17. To the fullest extent permitted by law, DigiDevs excludes all liability (including negligence), for any personal injury; or any direct, indirect or consequential loss or damage (including loss of opportunity); arising in connection with the promotional offer, competition or subscription, including that which arises through:
1. any technical difficulties or equipment malfunction (whether or not under DigiDevs control); 
2. any theft, unauthorised access or third party interference;
3. any claim or reward that is late, lost, altered, damaged or misdirected (whether or not after their receipt by DigiDevs) due to any reason beyond the reasonable control of DigiDevs; 
4. any variation in reward value to that stated in these Terms and Conditions; and
5. any tax liability incurred by a claimant.
18. As a condition of accepting a reward, claimants may be required to sign any legal documents as and in the form required by DigiDevs and/or reward suppliers in their absolute discretion, including a legal release and indemnity form.
