  1. Background
    1. DigiDevs (DigiDevs) is the owner and operator a website located at https://digidevs.com.au (Site).
    2. By using the Site, you (the user) agree to be bound by the Terms of Use as published below, and which can be amended at anytime at DigiDevs's discretion. 
    3. Your use of the Site indicates your acceptance of these Terms of Use.

    1. You agree that by completing and signing this Customer Order, the you agrees that it will be bound the Customer Contract (Terms and Conditions) in connection with any Goods and Services supplied by DigiDevs:

      2. as amended from time to time.
    2. It is your responsibility to review and familiarise themselves with your respective rights and obligations under the Customer Contract (Terms and Conditions).

  10.  Promotions and Subscriptions
    1. You agree that by entering into any promotions, subscription or competition, you will be bound by the DigiDevs Promotions and Subscriptions (Terms and Conditions):
      1. As published at https://digidevs.com.au/promotions; and
      2. As varied from time to time.
    2. It is your responsibility to review and familiarise themselves with your respective rights and obligations under the DigiDevs Promotions and Subscriptions (Terms and Conditions).
  11. Liability
    1. To the fullest extent permitted by law, DigiDevs will not be liable to any person or entity for any direct, indirect or consequential loss arising under any theory of liability (including by way of negligence) and which arises in connection with:
      1. the use of this Site; or
      2. the reliance of any information on this Site including any publications contained on, or liked to or from the Site.
    2. DigiDevs does not provide any warranty in relation to your use of the Site as to the currency, completeness or accuracy of information contained in the Site.
    3. The Site and its contents are provided entirely “as is”. DigiDevs excludes all implied conditions and warranties with respect to the Site and its content, excluding any implied condition or warranty the exclusion of which would breach any statute or cause any part of this clause to be void. 
    4. If any law implies a condition or warranty into these Terms of Use which cannot be lawfully excluded, then to the fullest extent permitted by law, DigiDevs’s liability for any such breach will be limited:
      1. to the supply of the relevant goods and services again; or 
      2. payment of the cost of having the relevant goods and services re-supplied.
    5. For all other loss to which clause 9 does not apply, our total liability will be limited to the total aggregate amount of $1.00.
